What is Domestic Violence?
Domestic violence is considered a type of battery, where there is an intentional causing of bodily harm to a family or household member, or by making physical contact in an insulting or provocative way with a family or household member. The Illinois Domestic Violence Act defines a relationship as between:
- Spouses or former spouses;
- Persons who are currently or who were dating;
- A parent or stepparent and a child;
- Parents who have children in common;
- Family members related through blood; and
- Disabled or elderly adults and their caregiver.
Domestic violence charges may include battery, aggravated domestic battery, violating a temporary restraining order, telephone harassment, or stalking. Each one carries with it the possibility of jail time, counseling, and a hefty fine. Anyone who pleas to, or is found guilty of domestic battery, cannot receive court supervision, even if it is a misdemeanor, and it is someone’s first offense. Domestic violence crimes can be either a misdemeanor or a felony, depending on the facts and circumstances of a given case.
